These Terms of Service ("Terms") govern your access to and use of Caret's software, platform, APIs, Documentation, and related tools, including the website www.caretive.ai, and all related software made available by Caret to help you write, edit, and build software (collectively, the "Service"). By using the Service, you agree to these Terms.

Please also read our Privacy Policy, which explains how we collect, use, disclose, and process personal data.

If you are entering into these Terms on behalf of an entity, you represent that you have the legal authority to bind that entity.

1. Access and Use

1.1. Provision of Access: Caret is an AI coding partner designed to help developers write, edit, and build software more easily and efficiently. Subject to your compliance with these Terms, Caret grants you a limited right to access and use the Service.

1.2. Content: You may provide inputs to the Service ("Inputs") and receive code or other outputs ("Suggestions"). We may use this Content to provide and maintain the Service. You warrant that you have the necessary rights to provide the Inputs.

1.3. Model Training: CARET WILL NOT USE YOUR CONTENT TO TRAIN ANY AI MODELS, unless you've explicitly agreed to it. You can manage your preferences in the Service settings.

1.4. Limitations for Suggestions: You acknowledge that AI-generated Suggestions may contain errors and are not a substitute for human judgment. You are responsible for evaluating the accuracy and appropriateness of any Suggestions.

1.5. Use Restrictions & Open Source License: Your use of the hosted Service is subject to restrictions against reverse-engineering, developing competitive models, or infringing on rights. However, the underlying source code of Caret is licensed under the Apache License 2.0. These Terms do not limit your rights under that license. Where these Terms conflict with the Apache License 2.0 regarding the source code, the Apache License 2.0 will prevail.

1.6. Beta Services: We may offer Beta Services for evaluation. They are provided "as-is" and without warranty. USE BETA SERVICES AT YOUR OWN RISK.

2. Eligibility and Account

You must be at least 18 years old to use the Service. You are responsible for providing accurate account information and maintaining the security of your password.

3. Payment Terms

Certain features require payment. All fees are in U.S. Dollars and are non-refundable, except as required by law. We use Stripe for payment processing, and by using our paid services, you agree to their terms. Subscriptions auto-renew unless canceled at least 24 hours before the renewal date.

4. Ownership and Licenses

We own the Service and its intellectual property. You own your Inputs. We assign to you all our rights, if any, in the Suggestions. If you provide feedback, you grant us the right to use it freely.

5. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES. OUR LIABILITY IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE LAST SIX MONTHS OR $100.

6. Dispute Resolution

You agree to resolve disputes with us through binding arbitration, not in court. You waive your right to a jury trial and to participate in class actions.
